DRAFT — pending attorney review
About this policy
This policy applies to "consumer health data" that Brightway Operations LLC collects through NoPlateau, as defined by Washington's My Health My Data Act, Nevada law and similar laws. Effective date: [effective date].
1. Consumer health data we collect, and why
Workout data you log: exercises, sets, reps, weights, effort ratings, workout times and durations. Body measurements and body weight you choose to add. Journal entries and goals about your training. Any health-related notes you choose to type. We use it only to provide the features you ask for: saving and syncing your data, showing your history, progress charts and records, suggesting weights and programs, showing your goals, and sending reminders you set up. Progress photos stay on your phone and are not collected by us.
2. Sources
You. We collect consumer health data only from what you enter in the App.
3. Consumer health data we share
The categories in Section 1, only as needed to run the App, and with a coach only if you choose to share specific data with them (we will ask for your separate consent before any such sharing).
4. Who receives it
Service providers (processors) that host and run the App for us under contract and only on our instructions: our database, sign-in and hosting provider (Supabase, servers in the United States). A coach, only if you separately consent to share with them. We have no affiliates that receive it. We do not sell consumer health data.
5. Your rights and how to use them
You can: confirm whether we collect, share or sell your consumer health data; access it, including a list of the third parties and affiliates it was shared with or sold to and how to contact them; withdraw your consent; and have it deleted. Use the in-app tools (Profile → Export my data, Profile → Delete account) or email privacy@noplateau.app. We respond within 45 days, and may extend once by 45 days with notice and a reason. If we refuse a request, you may appeal by replying to our decision; we will respond in writing within 45 days, and if we deny the appeal we will tell you how to contact the Washington Attorney General (or your state attorney general) to file a complaint.
